Frequently Asked Questions

1) Which areas of the country do you cover?

BB Law is based in Cheshire but can and do travel to any part of England or Wales. In fact many clients find it more cost effective to instruct BB Law than to instruct a more local firm. The fixed fees listed on the CHOOSE A FIXED FEE page are based upon cases being heard in Magistrates’ courts and Crown courts located within Cheshire, Staffordshire or Greater Manchester. An additional fee may apply for cases that involve attendance at more distant courts.

2) I have legal expenses insurance as part of my home or car insurance policy, am I entitled to ask my insurance company to pay your fees direct to you?

Quite possibly, yes. You need to contact your insurance company and ask them if they will pay the cost of your representation, if they say yes, then in most cases BBLaw will agree to act on the basis that the invoice will be sent direct to your insurance company.

3) Your fees seem very reasonable, are you going to do a good job?

Paying a lot of money for a motoring solicitor doesn’t necessarily mean you are going to be getting the best motoring solicitor. You don’t have to pay a fortune to get a good lawyer! 4) The police want to interview me at my house or a police station, what should I do?

It is absolutely vital that you have legal advice before you are interviewed, cases are very often lost or won at this stage. Contact Bobby now! BBLaw can either give you advice over the phone or let you know what it will cost you to have a solicitor present. If you are to be interviewed at a police station then you are entitled to have a solicitor present FREE OF CHARGE regardless of your financial circumstances.

 

5) I have received a Summons from the court, what should I do now?

Contact BB Law now! Even if it’s just to have a quick chat about your options, you would always be well advised to consult a lawyer immediately upon receiving a Summons from the court, particularly before you return any paperwork.

6) If I’m found guilty of this offence I’ll likely have 12 or more penalty points on my licence for offences committed within a 3 year period, am I definitely going to be disqualified under the ‘totting up’ rules?

No, not definitely but you are going to need to persuade the court to use its discretion not to disqualify you for the minimum 6 months period. This is why you would be well advised to seek legal assistance, which is exactly what BB Law are here for

7) I passed my driving test within the last 2 years, will I get banned if I get 6 points or more?

6 points on your licence won’t get you disqualified but if you are caught by the new driver provisions and accumulate 6 or more points within 2 years of passing your test then your licence will be revoked by the DVLA and you will need to re-apply for a provisional licence and then re-sit all parts of your driving test. Points incurred within the 3 years prior to you passing your test will also count towards the 6 points. BB Law can seek to persuade the court to deal with you in a way that avoids revocation. 8) If you get my case dropped or if I am found Not Guilty, can you recover my defence costs from central funds?

BB Law can almost certainly recover some of your costs from central funds but the government changed the law to put a ‘cap’ on the proportion of costs that are recoverable in cases commenced after 1/10/12. The good news is that BB Law will often seek to recover 100% more costs than most other firms on the basis that all the work we do is done with ‘exceptional competence, skill and expertise’, which is the criteria applied to applications for costs above the capped rates.

9) I represented myself or another firm of solicitors represented me at the Magistrates’ Court and I want to appeal against my conviction or my sentence, can you help?

Yes, but you will need to act fast because there are time limits involved. Call or email with the details and we will tell you what we think your chances are of winning an appeal and how much it is likely to cost you.

10) I have been summoned with Speeding AND Failing to identify driver but I only want to plead guilty to one of the offences.

BB Law can negotiate with the Crown Prosecution Service and usually ensure one of the offences is dropped. Contact BB Law to discuss your options.

 

11) I have been summoned with more than one offence, can you negotiate with the prosecution to get some of the offences dropped?

Yes! BB Law can often persuade the prosecution to drop some offences in circumstances where you have been summoned with multiple offences. The amount of money you save in fines could be more than the cost of our fees!

 

12) Do I have to attend court in person?

If you are subject to Bail then the answer is yes, however, if you are simply summoned to attend court then we can often attend court on your behalf and deal with the case in your absence depending on the circumstances.

 

13) I am being prosecuted for a criminal offence such as Assault or Theft, do you only do motoring cases or can you help me as well?

BB Law is dedicated to representing drivers who are facing prosecution for motoring / road traffic offences, however, BBLaw will occasionally agree to represent persons facing prosecution for other offences before the criminal courts. For example, BB Law will accept instructions to defend prosecutions under the Dangerous Dogs Act.

 

14) I have already got a solicitor but my application for legal aid has been refused, can you help?

Yes, BB Law can take over your case at any stage and all you have to do is ask your current solicitor to post your file to us. Not all legal aid firms are geared up to representing clients on a privately funded basis, whereas, BBLaw only do privately funded work.

15) I have looked at the ‘FIXED FEES’ page but I still can’t work out how much my particular case is likely to cost me!

It’s not always easy to predict how much work is involved in each case but give Bobby a call on 07764 757 214 and he will explain your options and give you a good idea of what the cost will be.

 

16) What if I change my instructions halfway through the case or the case becomes more complicated than first thought?

BB Law’s range of fixed fees cover most eventualities but if things change substantially for any reason then BB Law will inform you straight away and will always let you know about any additional fee before incurring it.

 

17) I have heard the court can order me to pay prosecution costs, is this right and how much are they likely to be?

If your case is dropped or you are found Not Guilty then the court will not order you to pay prosecution costs. However, if you end up pleading guilty or are found guilty then in most cases the court will order you to contribute towards the prosecution’s costs. These costs vary according to your income, the circumstances of the case and how much work the prosecution have had to do. Currently the average prosecution costs for a motoring case are £35 – £100 for a guilty plea at an early hearing, increasing to £150 for a guilty plea after a trial has been fixed, rising again to £300 – £750+ for cases that go all the way to trial.

18) Do your fees include the court costs?

No but we know what factors can reduce the costs order and make sure the court is aware of those factors to try and ensure any costs order is kept to an absolute minimum.

19) Do your fixed fees include disbursements such as car parking and travel expenses?

Unless told otherwise, you can assume that disbursements such as car parking and travel expenses are included within a fixed fee.

20) Do you add VAT to your fees?

No

​

21) I am due in court tomorrow; can you represent me at short notice?

22) I am either a motorcyclist, HGV driver, PCV driver, Bus, LGV or Taxi driver, do you only represent private car drivers?

Subject to the nature of your case, BB Law can represent you regardless of what you were driving, from a mini-moto to a 44 tonne lorry!
